DAISA Marketer Agreement
Please read this agreement carefully before applying to become a Marketer for DAISA (Database for the Accommodation Industry in South Africa). By ticking the acceptance box on the registration form, you confirm that you have read, understood, and agree to be bound by these terms.
1. Nature of the Relationship
1.1 You are appointed as an independent, self-employed Marketer for DAISA. Nothing in this agreement creates an employment relationship, partnership, or joint venture between you and DAISA.
1.2 You are responsible for your own tax affairs, including registration with SARS and payment of any tax due on commissions earned under this agreement. DAISA will not deduct PAYE, UIF, or any other employee-related deductions from your commission payments.
1.3 You may work the hours you choose and are not required to work exclusively for DAISA, unless otherwise agreed in writing.
2. Territory
2.1 DAISA will assign you a territory, which may be defined as one or more whole towns/cities, or as one or more specific suburbs/areas within a larger city.
2.2 DAISA reserves the right to create, adjust, expand, reduce, or reassign territories (including suburbs within a city) at its sole discretion, in order to manage coverage across its marketer network.
2.3 Where DAISA assigns a suburb or area that was previously part of your territory to another marketer, this will not affect commissions already earned on members you referred before the reassignment took effect. You will continue to earn commission on those existing members for as long as you remain an active marketer and they remain active members, under the terms of Section 3 below.
2.4 You agree to canvass and recruit new members only within your currently assigned territory. Recruiting new members outside your assigned territory does not entitle you to commission on those members.
3. Commission Structure
3.1 Your commission structure consists of five payment tiers, applied in sequence to each member you refer, based on the number of monthly payments that member has made:
| Payment | Rate | Basis |
|---|---|---|
| 1st payment | As set out in your marketer profile | Always paid |
| 2nd payment | As set out in your marketer profile | Always paid |
| 3rd payment | As set out in your marketer profile | Paid only if you met your Monthly Target (Section 4) in the month that payment falls due |
| 4th payment | As set out in your marketer profile | Paid only if you met your Monthly Target in the month that payment falls due |
| 5th and all subsequent payments | As set out in your marketer profile | Recurring for as long as you remain an active marketer and the member remains active, paid only in months you meet your Monthly Target |
3.2 Your specific commission rates and Monthly Target are recorded in your marketer profile and may be viewed on your Marketer Dashboard at any time.
3.3 DAISA may change your commission rates and/or Monthly Target from time to time, by agreement with you. Any such change takes effect for the calendar month in which it is made, and applies to that entire month regardless of the specific day the change was made. Changes are never applied retroactively – commissions already calculated for previous months are not affected by a later change to your rates or target.
3.4 Commissions are calculated on the membership fee actually charged to the member for their billing period, converted to a monthly equivalent where the member is on a quarterly, semi-annual, or annual billing plan.
4. Monthly Target
4.1 Your Monthly Target is the minimum number of new members you must refer in a calendar month in order to qualify for your 3rd, 4th, and 5th-tier (and onward) commissions for that month.
4.2 Your Monthly Target is assessed fresh, independently, for each calendar month. Meeting your target in one month does not carry over or guarantee qualification in a future month; equally, missing your target in one month does not permanently disqualify you from future months.
4.3 If you do not meet your Monthly Target in a given month, your 1st and 2nd tier commissions for that month are still paid in full. Only your 3rd, 4th, and 5th+ tier commissions for that month are affected, and will show as “Not Qualified” on your dashboard and statements.
5. Referrals and Attribution
5.1 A member is permanently linked to the marketer who was responsible for their territory at the time they joined, or to whom they were otherwise correctly attributed. This link does not change if DAISA later reassigns that territory to a different marketer.
5.2 If your status changes to inactive (see Section 7), DAISA will stop paying commission on your existing referred members from the date your status changes. Those members’ ongoing business becomes part of DAISA’s own portfolio from that date. If DAISA later appoints a new marketer to that territory, the new marketer will only earn commission on new members who join from their own appointment date onward, not on members you already referred.
6. Payment
6.1 Commissions will be calculated monthly and paid to you according to DAISA’s standard payment schedule, subject to your marketer status remaining Active.
6.2 DAISA reserves the right to withhold or reverse commission where a referred member’s payment is refunded, reversed, disputed, or found to have been fraudulently obtained.
7. Status, Suspension, and Termination
7.1 Your marketer status may be Active, Suspended, or Resigned, as reflected in your marketer profile.
7.2 DAISA may suspend or terminate your status at its discretion, including (without limitation) for breach of this agreement, misrepresentation to prospective members, conduct that damages DAISA’s reputation, or extended inactivity.
7.3 You may resign as a marketer at any time by giving DAISA written notice.
7.4 On termination or resignation, Section 5.2 applies to your existing referred members.
8. Conduct
8.1 You agree to represent DAISA’s membership offering accurately and honestly to prospective members, and not to make promises or representations on DAISA’s behalf beyond what is published in DAISA’s official materials.
8.2 You agree to comply with all applicable laws in the course of your marketing activities, including but not limited to the Protection of Personal Information Act (POPIA) 2013 in your handling of any prospective or existing member’s personal information.
8.3 You will not use DAISA’s name, branding, or member/prospect information for any purpose other than performing your role as a marketer under this agreement.
9. Confidentiality
9.1 You agree to keep confidential any non-public information you become aware of regarding DAISA’s business, pricing, commission structures, member data, or other marketers, both during and after your time as a marketer.
10. General
10.1 This agreement is governed by the laws of the Republic of South Africa.
10.2 DAISA may amend this agreement from time to time. Continuing to act as a marketer after being notified of a change constitutes acceptance of the amended terms.
10.3 If any provision of this agreement is found to be unenforceable, the remaining provisions will continue in full force.
